Terms of Service

1. Acceptance.

By downloading, installing, or using Nimzey ("the Service") — including the desktop app and the website at nimzey.com — you agree to these Terms of Service ("Terms"). If you don't agree, please don't use Nimzey.

2. What Nimzey is.

Nimzey is a desktop application that runs on your computer and captures your creative work — timelapses, screenshots, GIFs, and screen recordings — plus a companion web service for managing your account and subscription.

3. Eligibility.

You must be at least 13 years old (or the minimum age in your country) to use Nimzey. If you use Nimzey on behalf of a company, you confirm you have authority to bind that company to these Terms.

4. Your account.

You're responsible for keeping your account credentials safe. We use one-time login links sent to your email — don't share them. Notify us immediately if you suspect unauthorized access.

5. Subscriptions and billing.

• Free trial — Nimzey offers a free trial. We may change trial length or terms at any time.
• Monthly plan ($5/mo) — Billed every month via Stripe. Auto-renews until canceled.
• Founders plan ($40 one-time) — A single payment for lifetime access to the current set of features. "Lifetime" means for as long as Nimzey continues operating.
• All prices are in U.S. dollars and exclusive of taxes where applicable.
• We may change pricing at any time. Changes apply to future billing cycles, not your current one.

6. Cancellation.

You can cancel your Monthly plan anytime from the account page or via Stripe's billing portal. Your subscription stays active until the end of the current billing period, then ends — no refund for unused time. The Founders plan is a one-time payment and can't be canceled (see refund policy below).

7. Refunds.

If something's wrong, email nimzeyapp@gmail.com within 14 days of your purchase and we'll work it out. We don't offer refunds outside that window.

8. Your content.

You own everything Nimzey captures from your screen. Period. We don't claim any rights to your timelapses, screenshots, recordings, or designs. They live on your computer.

The only things we hold are your account info (email, plan, license key) and anonymized diagnostics. See the Privacy Policy for details.

9. Acceptable use.

Don't use Nimzey to:

• Record other people without their knowledge or consent where that's illegal.
• Capture content that infringes someone else's intellectual property.
• Break the law or harm others.
• Reverse-engineer, decompile, or attempt to extract the source code of the app (except where permitted by law).
• Resell access to Nimzey or share your account with others.

10. License to use Nimzey.

While your subscription is active, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use Nimzey on your devices. We retain all rights to the software, branding, and design.

11. Updates.

Nimzey may update itself automatically to ship bug fixes and new features. Updates are part of the Service.

12. Third-party services.

Nimzey integrates with third-party services (Stripe for payments, Supabase for accounts, Resend for email, Vercel for hosting). Their terms and privacy policies apply where they handle your data.

13. Disclaimers.

Nimzey is provided "as is" and "as available," without warranties of any kind. We don't guarantee the Service will be uninterrupted, error-free, or that captures will always succeed. Use Nimzey at your own risk.

14. Limitation of liability.

To the maximum extent permitted by law, Nimzey, its team, and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost data, lost work, or lost revenue. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

15. Termination.

We may suspend or end your access if you violate these Terms or use Nimzey in a way that risks harm to us, other users, or third parties. You may stop using Nimzey at any time by uninstalling the app and canceling your subscription.

16. Changes to these Terms.

We may update these Terms from time to time. If we make material changes, we'll notify you by email or in-app. Continued use after the change means you accept the new Terms.

17. Governing law.

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in California.
